These terms and conditions govern your use of profinto.com and any purchase of services or software licenses through our website. By accessing the website or completing a purchase, you agree to be bound by these terms in full.
Our software, Subscription Manager for Stripe, is a WordPress plugin. The use of the software itself is governed by a separate End User License Agreement (EULA), which you accept upon installation or activation of the plugin. These terms cover the website, your account, the ordering process, and your relationship with us as a customer.
When you purchase a license or download the free version of our plugin, an account may be created for you through Freemius, our software licensing and distribution partner.
You are responsible for keeping your login credentials secure. Do not share your account details with others. If you believe your account has been compromised, contact us immediately at info@profinto.com.
We reserve the right to suspend or terminate accounts if we detect suspicious activity, security breaches, or violations of these terms.
You must be at least 18 years old to create an account or make a purchase. If you are under 18, you may only use our services with the involvement and consent of a parent or legal guardian.
All prices on our website are listed in euros (EUR). Where applicable, prices are shown excluding VAT. The applicable VAT rate will be calculated and displayed during checkout based on your location.
All purchases are processed through Freemius, our authorized reseller and payment processor. By completing a purchase, you also agree to the Freemius terms of service.

We reserve the right to change our prices at any time. If you have an active subscription, any price change will only take effect at the start of your next billing period after the current term ends. We will notify you of price changes in advance.
Our paid plans are offered as recurring subscriptions, billed either monthly or annually through Freemius. When you subscribe, you authorize recurring charges to your chosen payment method at the interval you selected.
If you choose an annual plan, you pay for a fixed term of 12 months. When that initial fixed term expires, your subscription will not automatically renew into another 12-month commitment. Instead, it converts to an indefinite rolling month-to-month agreement at the applicable monthly rate.
This is required under Dutch law (Article 6:236 sub o and p of the Dutch Civil Code). We will not lock you into a new fixed-term contract without your explicit renewed consent.
You can cancel the rolling month-to-month subscription at any time with a maximum notice period of one month. Cancellation takes effect at the end of the current monthly billing cycle.
Monthly plans run on a rolling month-to-month basis from the start. You can cancel at any time, and your access will continue until the end of the current paid month.
You can cancel your subscription through your Freemius account dashboard or by contacting us at info@profinto.com. We will process cancellation requests promptly.
Under the EU Consumer Rights Directive (Directive 2011/83/EU) and its implementation in Dutch law (articles 6:230o and following of the Dutch Civil Code), you have the right to withdraw from an online purchase within 14 calendar days without giving a reason.
The 14-day withdrawal period starts on the day you enter into the contract (the day of purchase). During this period, you may cancel your order and receive a full refund.
Our plugin is digital content that is not supplied on a tangible medium (such as a DVD or USB drive). Under EU law, the right of withdrawal for digital content can be waived before the 14-day period expires, but only when all three of the following conditions are met:

“I expressly consent to the immediate delivery of this digital content and acknowledge that I thereby lose my right to withdraw from this contract once the download has begun.”
This consent is presented clearly during the checkout process. It is not pre-checked. You must actively opt in.
If you do not provide this consent, your 14-day withdrawal right remains intact, and you may request a full refund within that period.
To withdraw, send a clear statement of your decision to cancel to info@profinto.com within the 14-day period. You do not need to use a specific form, but your message must unambiguously state that you wish to withdraw. We will confirm receipt and process your refund within 14 days using the same payment method you used for the original purchase.
If you have validly waived your right of withdrawal as described in section 6, refunds are handled at our discretion on a case-by-case basis.
If we are unable to deliver the product as described on our website, or if the product is fundamentally defective and we cannot resolve the issue within a reasonable timeframe, you are entitled to a full refund.
Refunds, when issued, will be processed through Freemius using the same payment method you used for the original purchase.

All content on this website, including text, images, graphics, logos, icons, and design elements, is the property of ProductTickler B.V. or its licensors. This content is protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from our website content or branding without prior written permission from us.
The software (Subscription Manager for Stripe) is licensed, not sold. The terms of the software license are set out in the EULA, which governs what you may and may not do with the plugin code.
To the maximum extent permitted by Dutch law, we are not liable for any indirect, special, incidental, consequential, or punitive damages arising from or related to your use of our website, services, or software. This includes, but is not limited to, lost profits, lost revenue, business interruption, loss of data, and loss of goodwill.
Our total aggregate liability for any and all direct damages arising from or related to these terms, our services, or our software is limited to the total amount you have paid to us in the 12 months immediately preceding the event that gave rise to the claim.
Nothing in these terms excludes or limits our liability for damages caused by intentional acts (opzet) or gross negligence (bewuste roekeloosheid) on our part, in accordance with the Dutch Civil Code. These exclusions cannot be contractually overridden under Dutch law.
Our software and services are provided on an “as is” and “as available” basis. We do not make any implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement. While we strive to keep the plugin reliable and functional, we cannot guarantee uninterrupted or error-free operation.
You acknowledge that free and open-source software components may be included in the plugin, and those components are provided without any warranty by their respective authors.
Our website may contain links to third-party websites, services, or resources. These links are provided for convenience only. We do not control, endorse, or take responsibility for the content, privacy policies, or practices of any third-party websites.
Visiting a third-party link from our site is at your own risk. We encourage you to read the terms and privacy policies of any external site you visit.

If you have an active subscription, updated terms will apply starting from your next renewal date. If you do not agree with the updated terms, you may cancel your subscription before the renewal date.
If any provision of these terms is found to be invalid, unenforceable, or in conflict with applicable law by a competent court, that provision will be modified to the minimum extent necessary to make it enforceable, or removed entirely if modification is not possible. The remaining provisions will continue in full force and effect.
These terms are governed by and construed in accordance with the laws of the Netherlands.
Any disputes arising from or in connection with these terms will be submitted to the competent court in [COURT_JURISDICTION], the Netherlands. However, this does not affect any mandatory consumer protection rules in your country of residence that may apply in your favor.
